Post for Me – Terms of Service

Welcome to Post for Me (“Service”), owned and operated by Day Moon Development LLC (“we,” “our,” or “us”). By accessing or using the Service—including its API, dashboard, website, and any related features—you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Eligibility & Account

  • You must be at least 18 years old and able to form a binding contract.
  • You agree that the email you provide is accurate and kept current.
  • You are responsible for all activity that happens under your account, including API keys.

2. Use of the Service

  • You may use the Service only as permitted by law and these Terms.
  • You retain all rights to content you post through the Service; you grant us a limited license to transmit, store, and process that content solely to provide the Service.
  • You must have the necessary rights to post any content to third-party social platforms through our APIs.

3. Prohibited Conduct

You agree not to:

  1. Reverse-engineer or attempt to gain unauthorized access to our systems.
  2. Interfere with other users or the integrity of the Service.
  3. Use the Service to send spam, illegal content, or content that violates third-party rights.
  4. Exceed rate limits, scrape, or abuse the API.

We may suspend or terminate your account for violations.

4. Fees & Billing

  • Usage is metered. Each “post” sent to a social platform counts toward your bill.
  • Fees, rates, and payment schedules are shown in the dashboard and may change with 30 days’ notice.
  • All payments are processed via Stripe. You authorize us to charge your payment method for due amounts.

5. Service Availability

We aim for high uptime but do not guarantee uninterrupted or error-free operation. Planned maintenance and emergencies may cause downtime.

6. Third-Party Platforms

Your posts are subject to the terms and policies of each social-media site (e.g., X/Twitter, LinkedIn). We are not responsible for platform actions such as removals, rate limits, or bans.

7. Intellectual Property

  • Our software, trademarks, and branding are our exclusive property.
  • You may display our name or logo only to identify your integration with the Service and in compliance with our brand guidelines.

8. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Day Moon Development LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, even if advised of the possibility. Our total liability for any claim relating to the Service will not exceed the greater of (i) $100 or (ii) amounts paid by you to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold us (and our affiliates, officers, and employees) harmless from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate the Service or your account at our discretion, with or without notice, for any breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any legal action must be brought in the courts located in Delaware.

13. Changes to These Terms

We may modify these Terms at any time. If changes are material, we will notify you by email or through the dashboard at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
